1. Scope

These Terms apply to the official Website, its content and public functions.

They do not replace a quotation, service order or separate contract entered into between Wafi and a customer.

Where a valid written agreement governs a specific service, that agreement will govern the relevant service to the extent of any conflict.

2. Nature of the Website

The Website is Wafi's informational and commercial Website and allows visitors to review service information, contact Wafi, request a demo or support, subscribe to communications and use Wafi Smart.

Displaying a service, feature or plan does not mean that it is available to every customer at all times unless availability is confirmed in an approved quotation or agreement.

Submitting a form, demo request or enquiry does not by itself create a binding contract or final commercial acceptance.

3. Permitted Use

You may use the Website lawfully to:

Review information.

Contact Wafi.

Submit enquiries.

Request a demo or support.

Subscribe to communications with your consent.

Use the public functions available on the Website.

4. Prohibited Use

You must not:

Attempt unauthorised access to restricted systems, data or areas.

Disrupt or damage Website operation.

Bypass security or verification measures.

Use automated tools abusively.

6. Wafi Smart

Wafi Smart is an automated intelligent assistant and is not a human employee.

It is intended to help visitors understand Wafi information, communicate about services and use the Website.

Automated responses may contain errors or omissions and do not, by themselves, constitute:

A binding offer.

Acceptance of a contract or purchase request.

A guarantee that a feature or price is available.

Legal, financial or other specialist professional advice.

Important commercial decisions should be based on the relevant approved quotation, agreement or formal confirmation.

7. Accounts and Restricted Areas

General Website use does not currently require a public user account.

Administrative or internal areas may be restricted to authorised persons only.

The visibility or existence of a restricted route does not grant permission to access it.

8. Services, Plans and Prices

The Website may display information about available services, plans or prices.

Unless expressly agreed otherwise:

Website information does not by itself create a contract.

Submission of a request does not constitute acceptance.

The scope, price, duration and other commercial obligations are governed by the applicable approved quotation or agreement.

General Website information, plans and prices may be updated for future transactions without changing an existing contract.

Nothing in these Terms excludes mandatory consumer rights where they apply.

They may not be copied, commercially reused or exploited in a manner that infringes intellectual property rights without appropriate permission.

Lawful uses permitted by applicable law remain unaffected.

The Website may contain links or functions connected to third-party services.

Your use of those services is governed by the relevant third party's own terms and policies.

A link to an external service does not mean that Wafi guarantees all of its content or continued availability.

11. Website Availability

We seek to keep the Website operating appropriately but do not guarantee uninterrupted availability at all times.

Maintenance, updates and security or technical changes may be performed, and functions may be modified or discontinued where necessary.

We use reasonable efforts to maintain accurate Website information, but information may change or contain an error or omission.

General Website information does not replace an approved quotation or commercial agreement where one is required to define the service, price or obligations.

Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded.

13. Limitation of Liability

To the extent permitted by law, Wafi will not be liable for indirect losses arising solely from the use of, or inability to use, the general Website.

No limitation applies to liability that cannot lawfully be limited, fraud or intentional unlawful conduct, or mandatory consumer rights.

Liability relating to a paid service or specific project is governed by the agreement applicable to that relationship.

14. Force Majeure

Neither party will be responsible for delay or failure caused by events reasonably outside its control, to the extent recognised by applicable law.

The affected party should take reasonable measures to limit the impact and resume performance when reasonably possible.

15. Suspension of Use

Access to the Website or a function may be restricted or suspended where reasonably necessary for security, prevention of abuse, legal compliance, maintenance or enforcement of these Terms.

16. Changes to these Terms

We may update these Terms when the Website, services or legal requirements change.

The updated version will be published on this page with a revised date.

A change to these Website Terms does not automatically amend an existing contract where separate agreement is required.

17. Governing Law

These Terms are governed by the laws of the Sultanate of Oman, and disputes are subject to the competent courts of the Sultanate of Oman, subject to any mandatory rights or rules that cannot lawfully be excluded.
